LEGAL TERMS & POLICIES

By accessing, browsing, or placing an order on our website, you acknowledge and agree to be bound by the terms below. These terms are enforceable as a legally binding click-wrap agreement upon checkout.

1️⃣ DEFINITIONS

“Company”, “We”, “Us” refers to LESCHASTSIEUREUX LTD operating Hyvatooh™.
“You”, “Customer” refers to any individual placing an order on the site.
“Order” refers to a paid purchase confirmed through checkout.
“Carrier” refers to any third-party transporter contracted to deliver orders.

2️⃣ SHIPPING & PROCESSING POLICY

We process and dispatch orders within 2–5 business days (up to 6 days during sales or holiday periods).
Delivery timelines:
United States: 5–10 business days
United Kingdom: 5–7 business days
France, Belgium, Luxembourg, Switzerland, Germany, Spain, Italy, Sweden, Denmark, Austria, Netherlands: 5–10 business days
Rest of Europe: 10–15 business days
Canada & Australia: 10–30 business days
Rest of the world: 20–30 business days
Tracking information is sent by email or SMS once available. Tracking may take 3–7 business days to update.

3️⃣ CUSTOMER RESPONSIBILITY — ADDRESS, ACCESS & SIZE

The customer is exclusively responsible for entering accurate shipping information at checkout.
If an incorrect address is submitted and the order has already entered processing, no refund or reshipment will be issued.
Size or variant selections are the customer’s responsibility. Incorrect size chosen does not constitute a defect.

4️⃣ FRAUD, DISPUTES & CHARGEBACK POLICY

Zero-Tolerance Policy:
Any attempt to cancel after shipment without contacting us, open a dispute or chargeback with a bank or payment processor, or claim “item not received” while tracking shows delivered, will be treated as fraud under U.K. commercial law.
Chargeback Waiver (Binding):
By placing an order, you explicitly waive the right to initiate a chargeback without first contacting us and allowing 7 days to resolve the issue. If a customer files a chargeback without contacting us, the Company may submit evidence, recover damages and legal costs, and may initiate civil proceedings in the customer’s jurisdiction.
Dispute Evidence:
We reserve the right to provide IP logs, device fingerprints, proof of carrier delivery, SMS/email communication records, and proof of terms acceptance when defending the Company in legal or financial disputes.

5️⃣ CANCELLATIONS & REFUNDS

Orders may only be canceled if they have not yet entered processing.
Once processing has begun, cancellation is no longer possible.
If a parcel is not delivered within 70 days (standard shipping), we will issue a full refund, and the customer may retain the item if it later arrives.
This does not apply in cases where the parcel is marked “Delivered,” stolen after delivery, shipped to an incorrect address provided by the customer, or delayed due to remote-region logistics.
Packages marked as “Delivered” are legally considered delivered. We are not responsible for theft after delivery and do not issue refunds or replacements for such cases.
Refunds will not be issued for buyer’s remorse, incorrect size choice, delays within estimated timeframes, or refusal to pay customs fees.

6️⃣ PRE-ORDER & PARTIAL SHIPMENTS

If an order contains pre-order or out-of-stock items, available products will ship first.
Remaining items will be shipped as soon as available. Receiving only a portion of the order does not constitute grounds for refund.

7️⃣ PRICING, CURRENCY & DUTIES

Prices are displayed in the selected currency at checkout. Conversion fees, if charged, are the responsibility of the customer.
Customs duties and import fees, where applicable, are the responsibility of the customer. Refusal to pay customs duties does not justify a refund.

8️⃣ GOVERNING LAW & JURISDICTION

These terms are interpreted according to United Kingdom Law.
Any dispute must be submitted exclusively to U.K. commercial courts.
International purchasers agree to U.K. jurisdiction by completing checkout.

9️⃣ BINDING CONSENT & CONTRACT FORMATION

By clicking “Checkout,” submitting payment, or using our website, you legally acknowledge acceptance of these terms and enter into a binding commercial agreement with the Company.

FINAL NOTICE

Any attempt to misuse policies, exploit payment systems, or commit chargeback fraud may result in permanent blacklisting, legal action, and recovery of damages and collection fees.
